The reservation policy in India has its constitutional basis in Articles 15(4) and 16(4), which permit the state to make special provisions for socially and educationally backward classes. The Mandal Commission report (1980) recommended 27% OBC reservations implemented in 1990. The Supreme Court in Indra Sawhney (1992) upheld OBC reservation but capped total reservations at 50% and excluded the creamy layer.
